TERMS AND CONDITIONS FOR THE LAKE DISTRICT WHITE WATER RAFTING COMPANY
ACKNOWLEDGEMENT AND ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AGREEMENT
In consideration of the services of The Lake District White Water Rafting Company and as a condition to participate in The Lake District White Water Rafting Company excursions, I hereby agree as follows:
- Acknowledgement and Assumption of Risk:
Whilst white water rafting has an excellent safety record, I acknowledge the inherent risk in river excursions, including floating on river, whitewater entering and exiting the river craft, and transport to and from the river which could result in personal injury, death or property damage to myself, to property or to third parties. I also understand that such risks, whether known or unknown, cannot be eliminated from such river excursions. I herby expressly agree and promise to accept and assume all of the risk associated with such river excursions and further agree that my participation in these activities is purely voluntary, and I elect to participate in spite of such risks.
- Release and Waiver of Liability and Claims:
I hereby expressly agree to release, waive and discharge The Lake District White Water Rafting Company and affiliated companies, officers, directors, employees, and agents from any and all liability, claims, demands or causes of action that I may have now or hereafter for any and all injuries to my person or property that may be sustained by me during the river excursion or resulting from or associated with such river excursions.
- Agreement to Indemnify
I further agree to indemnify, save and hold harmless and defend The Lake District White Water Rafting Company from any loss, liability damage or cost that they may incur due to my presence and participation in any river excursion, including without limitation, subrogation and/ or derivative claims brought by any third party or insurer in connection with any injury or damage that I may suffer while on The Lake District White Water Rafting Company river excursions.
- Right to Refuse
It is the right of The Guide to refuse clients onboard if they are thought to be intoxicated or under the influence of drugs. There will be no credit refund in this event.
No alcohol may be taken onboard the rafts at any time.
Any wilful damaged incurred to the property of The Lake District White Water Rafting Company caused by negligence, malicious acts, or carelessness will be charged to you, the Client, and must be paid for at the time at current replacement value.
- No Shows
No refunds or credit will be issues if you fail to advise any amendments to the booking or fail to arrive in time for your excursion.
- We may refuse participation:
a. If a participant is not deemed to be of a suitable standard for a particular session, they may be asked to leave.
b. If a participant acts in such manner as to endanger themselves, or anyone else, they may be asked to leave the session.
c. For safety reasons, participants must wear safety helmets and buoyancy aids at all times on and around the water. A suitable wetsuit and closed footwear must be worn on all sessions. Participants may wear their own wetsuit providing it is long legged and has been approved by The Lake District White Water Rafting Company.
- Health and Safety Considerations:
a. All participants must be able to swim and confident to swim up to 25 metres
b. All participants must be physically able to get down within the raft. Anyone with a medical condition or injury which may impede their ability to be on or in the water should consult their medial practitioner to assess ability to participate. The Lake District White Water Rafting Centre should be informed of any medical conditions or injuries.
c. The maximum weight limit is 115 KG or 18 Stone. The maximum chest size is 51 inches. The Lake District White Water Rafting Company reserves the right to ask for you to be weighed. This is for safety reasons.
d. For any participant under the age of 18 years old, a parent or guardian, or adult authorised by the parent or guardian, will be required to agree to their participation with The Lake District White Water Rafting Company.
e. The wearing of Spectacles is not recommended whilst participating in any of our sessions. If you choose to wear spectacles you must accept that injury may occur and accept full responsibly for any such injury.
f. One adult must be present on every raft to accompany any minors.
- Photography and Videography Policy:
a. You may bring your own Go-Pro, or equivalent, onboard.
b. You may not take photographs or videos of any minors without the consent of their parent/ carers.
c. The Lake District White Water Rafting Company reserves the right to use any photographs or videos for marketing and promotional purposes. If you prefer that your images are not included, please let us know, and we will exclude them from future promotions.
d. The Lake District White Water Rafting Company reserves the right to keep all footage for up to three years.
- Booking and Cancellation Policy
a. All activities must be paid in full at the time of booking
b. Booking Confirmation must be brought to your excursion
c. Each session always includes a safety briefing, kitting up, time on the water and a shuttle back to the start
d. Should you cancel your booking more than 30 days before your session commences we will issue a full refund.
e. Should you cancel your booking for any reason less than 30 days before your session commences, there will be no refund.
f. No refunds will be offered which arise from circumstances that are beyond the control of The Lake District White Water Rafting Company, except for water levels on the rivers.
- Things To Remember
a. Bring your Booking Confirmation
b. Bring a spare pair of trainers/ closed water shoes which you don’t mind getting wet
c. Bring swimwear and a towel
d. Bring a Go-Pro (if you have one!)
e. Arrive 30 minutes before your start time
f. Get ready to have fun and get wet!
